Glossary of Terms

ADJUDICATION [ARBITRAGE] 

The process when the Tribunal considers the evidence and arguments from the Parties and makes a decision 

 

APPEAL [APPEL] 

An appeal that is permitted under the College By-laws 

 

BUSINESS DAY [JOUR OUVRABLE] 

A day when the College office is open for business. Business days do not include Saturday, Sunday, or statutory holidays.  

 

BY-LAW [RÈGLEMENTS ADMINISTRATIFS] 

The By-laws of the College.  

 

CASE CONFERENCE  [CONFÉRENCE PRÉPARATOIRE] 

A Case Management Conference, a Settlement Conference, or other meeting of the Parties under the Tribunal Rules of Procedure 

 

CASE [DOSSIER] 

A referral or appeal as described in the Tribunal Rules of Procedure 

 

CODE [CODE] 

The Code of Professional Conduct for College of Immigration and Citizenship Consultants Licensees 

 

COMMITTEE PUBLIC MEMBER  [REPRÉSENTANT DU PUBLIC AU COMITÉ] 

A person who:  

  • Is not a licensee of the College. 

  • Is not an immediate family member of a licensee of the College, and  

  • Does not have any obligation, commitment, relationship, or interest that could conflict with (or could be seen to conflict with) the College’s duty to regulate the immigration consulting profession and protect consumers of immigration services.   

DECISION PANEL [JURY DE DÉCISION]

The panel of 1, 2 or 3 Tribunal Members assigned by the Tribunal to adjudicate and decide a Case. 

 

DECISION [DÉCISION] 

The Order plus Reasons for that Order.  

 

DIRECTOR [DIRECTEUR] 

The person who works as the Director of Professional Conduct at the College. 

 

COLLEGE [College] 

The College of Immigration and Citizenship Consultants. 

 

ICRO [AEPI] 

The Independent Complaints Review Officer. 

 

MEDIATOR [MÉDIATEUR] 

A Tribunal Member or other person assigned by the Tribunal to communicate with the Parties to try to reach a settlement of all or part of a Case. 

 

MOTION [REQUÊTE] 

A request by a Party for an Order from the Tribunal. This Order may be a procedural Order or interim Order, or any other Order that the Tribunal has the power to make under the College’s Tribunal Rules of Procedure.  

 

ORDER  [ORDONNANCE] 

A binding order by the Tribunal, with specific orders that the Parties must comply with, including Procedural Orders made by persons authorized to make such Orders under the Tribunal Rules of Procedure. 

 

PROCEDURAL ORDER  [ORDONNANCE DE PROCÉDURE] 

An Order that requires 1 or more Parties to follow certain procedures or time deadlines; Procedural Orders may be made by a Tribunal Member assigned to the Case, by a person assigned to conduct a Case Conference, or by the Tribunal Manager under the Tribunal Rules of Procedure.  

 

INTERIM ORDER [ORDONNANCE PROVISOIRE] 

A temporary Order pending final disposition on the merits or otherwise of limited duration.  

 

PARTY OR PARTIES  [PARTIE OU PARTIES] 

The persons who have a right to participate in the Proceedings of the Case – including the College as represented by the College’s legal counsel, the Subject Party (licensee), and any other person permitted by the Tribunal to be a Party in the Case.  

 

PRESIDING MEMBER [PRÉSIDENT] 

The Tribunal Member in a Decision Panel who is designated by the Tribunal to preside over the adjudication process, which may include chairing an oral hearing.  

 

PRIVILEGED [PRIVILÉGIÉ] 

Subject to a privilege under the law of evidence, litigation privilege, solicitor-client privilege or the professional secrecy of advocates and notaries. 

 

PROCEEDING  [PROCÉDURE] 

Any process in the Tribunal’s consideration of a Case, which may include a Case Conference, Motion Adjudication, Adjudication or other written or oral process.  

 

RCIC [CRIC] 

Regulated Canadian Immigration Consultant.  

 

REGULATION [RÈGLEMENT] 

A regulation of the College.  

 

REPRESENTATIVE  [REPRÉSENTANT] 

A lawyer, licensed paralegal or other person authorized under the College Tribunal Rules of Procedure to represent a Party in any Proceeding at the Tribunal. 

 

RISIA (pronounced riz-ee-ah) [CRIEE] 

Regulated International Student Immigration Advisor. 

 

SUBJECT PARTY  [PARTIE VISÉE] 

The licensee who is or the firm or sole proprietorship that is the subject of regulation or enforcement by the College in the Case.  

 

TRIBUNAL MANAGER [GESTIONNAIRE DU TRIBUNAL] 

The person who manages the Tribunal Office, or their authorized delegate.  

 

TRIBUNAL [TRIBUNAL] 

Discipline Committee, Fitness to Practice Committee and Registrar Appeal Committee, and includes the Decision Panel assigned to make Decisions or Orders for a Case; the Tribunal Rules of Procedure do not apply to the Complaints Committee; Tribunal also includes the Tribunal Manager or Tribunal Office for matters that are not adjudicative. 

 

TRIBUNAL MEMBER [MEMBRE DU TRIBUNAL] 

A person appointed by the College Board of Directors to the Tribunal.  

 

TRIBUNAL OFFICE [BUREAU DU TRIBUNAL] 

The Tribunal Manager and other staff of the Tribunal Office.
