The College has released a new checklist to help Regulated Canadian Immigration Consultants (RCICs) draft Agent Agreements that comply with the Code of Professional Conduct and the Agents Regulation.
RCICs are responsible for registering any person or company operating outside Canada who assists with their practice. They are also required to enter into a written agreement when employing an Agent.
The Agent Agreement Checklist outlines what these agreements should include: Agent’s fees for services, termination terms and a section for signatures.
The checklist also provides guidance on what not to do. For example, agents may not accept payment from clients, as the licensee is responsible for paying the Agent. In addition, an RCIC cannot employ anyone as an Agent who is not registered and approved by the College or who resides in Canada.
RCICs are responsible for the actions of their Agents and both must comply with the Immigration and Refugee Protection Act, Agents Regulation, By-laws and Code of Professional Conduct.
